What is a Promissory Note?

A promissory note is a legally binding contract in which a borrower promises to repay a specific loan amount to a lender. It outlines every critical detail of the loan, including the exact repayment schedule and the penalties for defaulting.

What Does It Contain?

Before you receive any money from a bank or the federal government, you must sign a promissory note. Whether you are taking out a mortgage, a car loan, or federal or private student loans, the document always contains the same foundational elements.

The note dictates the exact loan principal (the amount you are borrowing), the interest rate (how much the lender charges you to borrow the money), the repayment term (how many months you have to pay it back), and the exact date your first payment is due.

✔ The Master Promissory Note (MPN)

If you borrow federal student loans, you will sign a specific type of contract called an MPN:

  • One Document: The Master Promissory Note allows you to take out multiple federal loans over a period of 10 years without having to sign a new contract every single semester.
  • Legal Weight: By signing the MPN, you legally promise to repay all loans disbursed under it, even if you do not complete your degree or cannot find employment after graduation.

Frequently Asked Questions (FAQs)

Can I break a promissory note?

You cannot break it without severe legal and financial consequences, including ruined credit, wage garnishment, and being sued by the lender. The only legal way to terminate the note is by paying off the debt or through specific bankruptcy proceedings.

Is a promissory note the same as a mortgage?

No. A promissory note is the legal promise to repay the debt. A mortgage is a separate legal document that uses your house as collateral to secure the loan outlined in the promissory note.
